Welcome to BlackBuy. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using BlackBuy, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

BlackBuy is a product discovery application that helps users find products from Black-owned businesses. The App allows you to:

• Scan product labels using your device's camera to identify products
• Search and browse a curated catalog of products from Black-owned businesses
• Save products and companies to your favorites
• Manage a checkout list to plan purchases across multiple retailers
• Access direct links to purchase products from their original retailers

3. User Accounts

You may use BlackBuy without creating an account. Optionally, you can sign in with your Apple ID to enable personalized features. When you sign in, you agree to provide accurate information and to keep your account credentials secure.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Extract, scrape, or harvest data from the App by automated means
• Interfere with or disrupt the App's servers, networks, or infrastructure
• Attempt to gain unauthorized access to any part of the App or its related systems
• Use the App to transmit malicious code, viruses, or harmful content
• Circumvent or attempt to circumvent any rate limits, usage restrictions, or security measures
• Misrepresent your identity or affiliation with any person or organization

5. Product Information and Pricing

Product information displayed in the App, including names, descriptions, images, and prices, is sourced from third-party retailers and may not always be current or accurate. BlackBuy does not guarantee:

• The accuracy, completeness, or timeliness of product information
• Product availability at any retailer
• That prices shown in the App match current retailer prices
• The quality, safety, or legality of any products listed

When you follow a link to a retailer's website, your purchase is governed by that retailer's own terms and conditions. BlackBuy is not a party to any transaction between you and a third-party retailer.

6. Intellectual Property

The App, including its design, code, graphics, logos, and content, is owned by BlackBuy and is protected by copyright, trademark, and other intellectual property laws. Product names, images, and descriptions belong to their respective owners and are displayed under fair use for informational and discovery purposes.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. Camera and Data Usage

The App requires camera access to scan product labels. By granting camera access, you acknowledge that:

• Images may be processed on-device and/or sent to third-party AI services (OpenAI) for analysis
• No images are permanently stored after processing
• You are responsible for ensuring you have the right to photograph any items you scan

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Product scanning results are provided by artificial intelligence and may not always be accurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKBUY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Inaccurate product information or pricing
• Purchases made through linked retailer websites
• Loss of data or unauthorized access to your account
• Service interruptions or technical failures

10. Indemnification

You agree to indemnify and hold harmless BlackBuy from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and without prior notice. Upon termination, your right to use the App ceases immediately. You may delete your account and all associated data at any time through the App's Profile settings.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
